Welcome to Recycled Learning! These Terms of Use govern your access to and use of our platform, including any content, functionality, and services offered. By using our platform, you agree to these terms.

1. Age Restrictions

Consumers may only use Our Platform and create Online Schools if they are at least 16 years of age. By using the Platform, you represent and warrant that you are not under the age of 16 years old. Furthermore, the Platform is not offered nor directed at children under the age of 16 and We do not knowingly collect personally identifiable information of children as School Owners.

2. Pricing and Availability

We strive to ensure all service and product descriptions on our Platform accurately reflect what we provide, but minor variations may occur due to ongoing development, bug fixes, and feature updates. This does not affect our responsibility for significant errors caused by gross negligence or misconduct.

Subscriptions

• Choose the appropriate Subscription for access to specific Platform features.
• Price changes will not affect active Subscriptions but may apply to renewals or new Subscriptions, with at least 30 days' notice. You may cancel the renewal if you disagree with the changes.

Pricing Accuracy

• Prices are reviewed at purchase. If errors occur, we will notify you promptly. Unresolved errors within 5 business days may lead to order cancellation and a refund.
• Orders are charged at the price shown at the time of purchase.

VAT

• Prices exclude VAT.
• VAT is applied based on your location and VAT registration status. Adjustments will reflect any VAT rate changes before payment processing.

3. Intellectual Property Rights and Licences

We grant you a limited, non-exclusive, revocable, worldwide, and non-transferable licence to use our Platform for creating, managing, and operating Online Schools, subject to these Terms of Use.

Your Content

• You retain ownership of copyright and intellectual property rights in your content (subject to third-party rights and licence terms).
• We do not claim ownership of your content but require certain rights to provide the Platform:

• Grant Us Rights

• A non-exclusive, royalty-free licence to use, store, and display your content for service provision.
• Permission to use anonymised data to improve our Platform.
• Limited rights to use your trademarks to promote your Online School and our Platform.

• Grant Other Users Rights

• View and interact with your content as part of your Online School.

Content created and uploaded by you remains your property. We are not liable for third-party content or intellectual property rights you include in your Online School.

Our Content

All materials within the Platform, including underlying code and user-facing features (unless otherwise stated), belong to us or are licensed to us and are protected under European and international intellectual property laws.

Your Commitments

By using our Platform, you agree:

• 1. Not to copy, modify, or reverse-engineer any part of the Platform.
• 2. Not to distribute, sublicense, or transfer the Platform to others without permission.
• 3. Not to circumvent or disable Platform security features.
• 4. To avoid using the Platform in ways that breach these Terms.

These terms ensure fair and lawful use while safeguarding both your rights and ours.

4. Third Party Service Providers

Recycled Learning may recommend or provide access to third-party tools, products, and services (“Third-Party Services”) via the Platform, including the Hire a Recycled Learning Expert webpage. These optional services aim to enhance your Online School’s capabilities but are used entirely at your discretion and risk.

Using Third-Party Services

• Choosing to use Third-Party Services is solely between you and the provider. You must review their terms, policies, and data practices before proceeding.
• Hire a Recycled Learning Expert: A directory of experts in course building, API integration, content creation, marketing, and more. You can search, hire, and communicate with providers directly. Submitting a project brief implies consent to be contacted by the chosen provider.
• Recycled Learning does not control, endorse, or warrant these services and is not liable for any service outcomes, interruptions, or disputes.

Responsibilities and Risks

• Using Third-Party Services requires entering into agreements directly with providers. Data exchanges or interactions occur exclusively between you and the provider.
• Recycled Learning is not responsible for data disclosures, modifications, or losses caused by these providers.
• Any use of Artificial Intelligence systems as Third-Party Services is at your own risk and may result in inaccuracies, intellectual property infringements, or unintended outcomes. You are accountable for the content provided to and generated by such systems.

Liability Disclaimer

Recycled Learning is not liable for any damages—direct, indirect, or consequential—arising from the use of Third-Party Services or agreements with providers. All risks and responsibilities rest with you.

5. Recycled Learning’s General Rights In Operating Its Platform

Recycled Learning reserves the right to modify, suspend, or terminate the Platform, its services, or any features at any time without prior notice.

Key Terms

1. Account and Content Access

• We may access your Account, Online School, and End-user Content for technical support, security, or legitimate business purposes.
• If your Account or Online School is terminated, we may retain an archival copy of your content for up to 9 months for compliance, internal purposes, or potential reactivation.

2. Removal and Monitoring

• We can remove users or content from the Platform without notice for any reason, including violations of these Terms of Use..
• We may, but are not obligated to, monitor End-user Content or interactions on the Platform.

3. Policy and Terms Changes

• Refund policies and Terms of Use can be modified at our discretion. Updated terms will be posted on our website and take effect upon posting. Continued use of the Platform indicates acceptance of the updated terms.
• Dispute resolution changes will not apply to disputes with actual notice before the change is posted

4. Platform Updates

• We may add, remove, or alter Platform features at any time.
• If a change materially impacts you, we will attempt to notify you beforehand, if practicable.
